KEY POINTS
Key points
- Candidate suitability alone does not establish legal eligibility for a role.
- Check the licence and restrictions, then residence and work status where applicable.
- Onboarding matters, but it cannot replace missing permission.
Read the professional permit before assigning duties.
Distinguish Approbation from temporary Berufserlaubnis. The law allows temporary permits to be restricted to particular activities or workplaces. “Has a permit” is not enough without checking the document against the role.
Assign responsibility for checking the current document and conditions, and identify matters needing authority clarification. A successful interview or examination is no substitute for checking authorisation.

Residence and work: a separate check where applicable.
The government portal describes employer duties when employing people from outside the EU and EFTA, including checking a valid residence title permitting employment and retaining a copy. Do not apply these rules indiscriminately without considering the candidate’s status.
Check validity, permitted activities and conditions; seek qualified advice if their effect is unclear. This guide does not cover every employer obligation. Review the official guidance and the particular case before employment starts.

Turn the start date into a readiness checklist.
We suggest a simple table: requirement, completion evidence, owner and latest update. “In progress” is not “complete”. Keep unresolved points visible so neither party mistakes them for an agreement.
Distinguish the desired date from the date the actual requirements permit. Where a step depends on another body’s decision, agree a review point rather than guaranteeing a date neither party controls. This is a proposed coordination method, not a government timetable.
Prepare the first week, not just the first hour.
A useful welcome plan introduces the team and the person responsible for questions, then systems, documentation and escalation when uncertain. Allow time to review expectations and training needs.
We do not prescribe a fixed integration period or promise unagreed follow-up services. We recommend a named contact and role-appropriate review points, with all duties remaining within the professional authorisation.

Pharmacy owner’s checklist before confirming the start.
This combines the basic regulatory requirements discussed above with suggested organisational arrangements. It is not a comprehensive compliance audit.
- Current authorisation and conditions match the intended duties and workplace.
- Residence and work permission are clear where required by the candidate’s status.
- Role, hours, agreement and expectations are understood.
- Outstanding requirements and their owners are identified.
- An induction contact, systems introduction and follow-up are planned.
- No activity outside the permit is requested under the label of training or a trial.
